Aliansi Bara-Baraya Bersatu Menuntut PT Makassar Transparan Tangani Kasus Sengketa Lahan

Makassar, Cakrawalaide.com – Aliansi Bara-baraya Bersatu kembali mendatangi kantor Pengadilan Tinggi (PT) Makassar di Jl.Urip Sumoharjo, dalam upaya meminta transparansi terkait surat hasil putusan banding yang dikeluarkan oleh PT Makassar, Senin (05/10/20).
Ansar selaku Penasehat Hukum (PH) warga menjelaskan, dari Lembaga Bantuan Hukum (LBH) Makassar sebagai kuasa hukum dari warga Bara-baraya, sama sekali tidak tahu mengenai surat putusan banding yang dikeluarkan oleh Pengadilan Tinggi (PT) Makassar.
“Setelah kami bertemu tadi dengan Humas PT Makassar, kami telah mendengar secara langsung bahwa putusan sudah ada di pengadilan negeri Makassar atau sudah disampaikan ke sana. Hanya saja selama ini lengadilan negeri Makassar belum memberitahukan secara resmi kepada kami mengenai surat keputusan ini,” jelasnya.
Sementara itu, mengenai status hukum dari putusan banding tersebut, Ansar menambahkan, sampai saat ini sebelum ada pemberitahuan resmi dari pengadilan, sebelumnya gugatan ini tidak diterima.
“Pada pengadilan negeri atau pengadilan sebelumnya, gugatan ini tidak diterima oleh putusan hakim, itukan dinyatakan banding oleh penggugat. Nah sampai saat ini belum ada pemberitahuan kepada pihak tergugat (warga) maupun kuasa hukumnya. Jadi sampai saat ini kami masih menunggu,” tambahnya.
Selain itu, Fahri selaku jenlap Aliansi Bara-baraya Bersatu menuturkan, bahwa surat yang dikeluarkan oleh Pengadilan Tinggi Makassar itu dinilai tertutup dan tidak demokratis.
“Selama berjalannya proses banding warga tidak pernah mendapat surat pemberitahuan dari PT seperti berkas dan register perkara, padahal sistem administrasi peradilan harus menyampaikan surat kepada yang tergugat dalam hal ini warga bara-baraya dan kuasa hukumnya,” tuturnya.
Fahri menjelaskan bahwa aksi tadi juga adalah sebagai bentuk pressure kepada PT yang dinilai berat sebelah.
“Nah melalui aksi tadi, harapannya ke depan semoga warga tetap semangat dalam mempertahankan hak-haknya, juga semoga unsur solidaritas kembali seperti dulu, tidak larut dalam euforia kemenangan di PN karena perjuangan ini akan semakin panjang dan berat, maka perlu solidaritas yang lebih besar lagi,” tutupnya.
