APD Tolak Perubahan RUU PKS Jadi RUU TPKS

Makassar, Cakrawalaide.com- Aliansi Perjuangan Demokrasi (APD) menuntut penolakan terhadap perubahan Rancangan Undang-Undang Penghapusan Kekerasan Seksual (RUU PKS), menjadi RUU Tindak Pidana Kekerasan Seksual (TPKS). Tuntutan tersebut menjadi salah satu dari 20 tuntutan yang dikeluarkan melalui rilis yang disebarkan pada aksi kampanye yang di depan kampus II UMI pada Rabu,(9/3/2022)

Humas Aliansi, Icha mengatakan bahwa penolakan tersebut terjadi karena RUU TPKS dianggap menghilangkan substansi dari RUU PKS.

“Kami dari aliansi menolak RUU TPKS karena didalam RUU TPKS itu banyak terjadi. Perubahan yang menghilangkan substansi dari RUU PKS, misalnya soal mendefinisikan kekerasan seksual dan bentuk bentuk kekerasan seksual juga banyak yang dihilangkan,” katanya.

Jendral lapangan (Jenlap), Arul Pravda, menganggap bahwa perubahan tersebut tidak medukung korban kekerasan seksual.

“Perubahan RUU PKS menjadi RUU TPKS semakin tidak mendukung korban kekerasan seksual dan kaum perempuan dan identitas gender lainnya,” anggapnya.

Selain itu ia juga mengungkapkan bentuk perubahan yang terjadi pada RUU PKS.

“Sebagai contoh didalam pasal mengenai bentuk-bentuk pelecehan atau kekerasan seksual yang awalnya berisis belasan poin, dalam RUU TPKS berkurang menjadi hanya beberapa poin saja,” ungkapnya.

Sementara itu berdasarkan temuan Reporter Cakrawalaide.com, draf RUU PKS per Februari 2017 berjumlah 115 pasal. Kemudian, jumlah itu turun drastis di draf RUU TPKS per 30 Agustus 2021 menjadi 43 pasal.

Sebelumnya RUU PKS menetapkan bentuk kekerasan sebanyak sembilan jenis : Pelecehan Seksual, Pemaksaan Perkawinan, Pemaksaan Kontrasepsi, Pemaksaan Aborsi, Perkosaan, Eksploitasi Seksual, Pemaksaan Pelacuran, Perbudakan Seksual, dan Penyiksaan Seksual.

Sementara RUU TPKS atau draf terbaru hanya menetapkan bentuk kekerasan menjadi empat : Pelecehan Seksual, Pemaksaan Alat Kontrasepsi, Pemaksaan Hubungan Seksual, dan Eksploitasi Seksual.

Sejalan dengan hal itu, Arul mengungkapkan bahwa perubahan ini akan mengakibatkan dampak yang besar terhadap penanganan kekerasan seksual .

“Menurutku perubahan ini akan berdampak sangat besar, contohnya di RUU dalam pasal tindak pidana pemerkosaan hanya mengakomodir mengenai penitrasi penis ke vagina, tapi dalam tindakan lain seperti sentuhan visik selain penitrasi penis ke vagina tidak dianggap pemerkosaan. Perubahan ini akan semakin mengkaburkan posisi korban,” pungkasnya.

Lebih lanjut, Arul mengungkapkan bahwa pemerintah tidak memiliki kepentingan terhadap pengesahan RUU PKS.

“Menurut kami, Rezim pemerintahan saat ini seakan tidak memiliki kepentingan untuk mengesahkan RUU PKS, atau memberi kesetaraan antara perempuan dan laki-laki baik dalam sektor ekonomi, politik, sosial dan sebagainya,” tambahnya.

Sementara itu, Icha berharap agar RUU PKS segera di terapkan untuk memberi payung hukum terhadap korban-korban kekerasan seksual.

“Sampai saat ini, belum ada aturan ataupun kebijakan terkait perlindungan terhadap korban kekerasan seksual. Jika aturan ini diterapkan setidaknya kami punya payung hukum, prosedur atau mekanisme untuk menangani kasus-kasus kekerasan seksual,” tutupnya.

Berikut beberapa pasal krusial dalam RUU PKS yang tak masuk di RUU TPKS.

– Bab II Asas dan Tujuan, Pasal 2-3
Pasal 2-3 membahas dasar-dasar penghapusan kekerasan seksual serta tujuan kekerasan seksual yang berorientasi pada korban.

– Bab III Ruang Lingkup, Pasal 4-10
Pasal 4-10 menjabarkan secara detail ruang lingkup penghapusan kekerasan seksual di sektor pendidikan, ruang publik, di lembaga pemerintahan, korporasi, hingga kekerasan seksual media sosial atau masyarakat.

– Bab IV Pencegahan
Penghapusan Pasal 11 tentang kategorisasi kekerasan seksual. Beberapa terminologi kategori kekerasan seksual juga dihapuskan di antaranya Pasal 15 tentang pemaksaan aborsi, Pasal 17 tentang pemaksaan perkawinan, Pasal 18 tentang pemaksaan pelacuran, Pasal 19 tentang perbudakan seksual, dan Pasal 20 tentang penyiksaan seksual.

– Bab VI Hak Korban, Keluarga Korban, dan Saksi
Terdapat 22 pasal yang mengatur tentang hak-hak korban, keluarga korban, dan saksi yang tidak dicantumkan dalam RUU TPKS.

Beberapa di antaranya yaitu hak korban atas penanganan, perlindungan, dan pemulihan tak diatur rinci dalam RUU TPKS. Padahal dalam RUU PKS hak korban tertuang dalam Pasal 22-23.

Kemudian hak atas perlindungan yang diatur dalam Pasal 24-25, hak atas pemulihan dalam Pasal 26-31 juga tak tertuang dalam RUU TPKS.

– BAB IX Pendidikan dan Pelatihan, Pasal 80
Pasal 80 mengatur kewajiban pemerintah untuk menyediakan pendidikan dan pelatihan bagi aparat penegak hukum, petugas Pusat Pelayanan Terpadu (PTT), serta pendamping korban.

Pasal 81-82 mengatur upaya penghapusan kekerasan seksual yang dilakukan Komisi Nasional Anti Kekerasan Terhadap Perempuan (Komnas Perempuan).

– BAB XIII Ketentuan Pidana
Pasal ini menjabarkan ketentuan pidana terhadap masing-masing kategori kekerasan seksual. Selain itu, terdapat pasal yang mengatur rehabilitasi khusus untuk terpidana kekerasan seksual.

Beberapa pasal hilang di antaranya Pasal 95-100 tentang aturan pemidanaan pada pelaku eksploitasi seksual; Pasal 105-107 tentang pemidanaan pemaksaan aborsi; Pasal 116-119 tentang pemidanaan pemaksaan perkawinan; Pasal 120-125 tentang pemidanaan pemaksaan pelacuran; Pasal 126-129 tentang pemidanaan perbudakan seksual; pasal 130-134 tentang pemidanaan penyiksaan seksual.
