Putusan Tak Objektif, Aliansi Bara-baraya Gelar Aksi

Makassar, Cakrawalaide.com – Aliansi Bara-baraya kembali menggelar aksi di depan gedung Pengadilan Tinggi (PT) Makassar, Jl. Urip Sumoharjo, Kamis (18/02/2021).
Andarias selaku humas menjelaskan, aksi yang digelar oleh Aliansi Bara-baraya ini, karena adanya putusan hakim PT Makassar yang tidak objektif.
“Hakim tidak objektif dalam pengambilan keputusan. Kami sangat kecewa dengan keputusan hakim saat ini,” jelasnya.
Selain itu, ia menambahkan, sengketa tanah yang melibatkan Nurdin Dg. Nombong dengan Kodam XIV Hasanuddin selaku penggugat, melawan warga Bara-baraya sebagai tergugat, selalu berhasil dimenangkan warga dalam perkara tersebut.
“Warga Bara-baraya telah memenangkan putusan pengadilan sebanyak 3 kali, dengan landasan hukum serta alasan-alasan yang jelas bahwa mereka berhak atas tanah tersebut,” ungkapan.
Namun kali ini, “Kami kalah dalam pengadilan ini dikarenakan adanya mafia pengadilan,” katanya.
Lanjutnya, jelang pandemi covid-19, pemerintah menerapkan Pembatasan Sosial Berskala Besar (PSBB) di Kota Makassar. Warga Bara-barayya tidak melakukan aktivitas apapun dalam mengawal kasus sengketa tersebut.
“Karena harus mengikuti instruksi pemerintah agar tak keluar rumah, hingga pada saat itu warga Bara-barayya harus menerima kekalahan di PT Makassar,” tambahnya.
Maka dari itu, Heri salah satu warga Bara-baraya mengatakan, “Indikasinya terjadi penyimpangan dalam prosedur peradilan Bara-barayya itu sangatlah kuat,” ungkapnya.
Ia juga menambahkan, akan terus memperkuat Aliansi Bara-baraya, dalam mengawal kasus sengketa pada upaya kasasi di Mahkamah Agung (MA).
“Maka, kami akan terus mengawal kasus ini khususnya [ditahap] kasasi,” tambahnya.
Selain memperkuat Aliansi, ia juga menuturkan akan terus menyuarakan ketidaksetujuan terhadap putusan banding, demi terwujudnya keadilan warga Bara-baraya.
“Utamanya itu adalah demi menegakkan keadilan. Kami akan memberikan peringatan kepada PT [Makassar]. Karena telah mengeluarkan putusan banding, yang tidak sesuai dengan putusan-putusa sebelumnya,” tutup Heri.
