Sengkarut Masalah Korupsi di Sulawesi Selatan

Makassar, Cakrawalaide.com – Di tengah pendemi Covid-19 yang melanda dunia termasuk Indonesia, tidak mengendurkan penanganan dan pengawasan tindak pidana korupsi yang masih terus terjadi di berbagai daerah. Di Sulawesi Selatan, Anti Corruption Committee (ACC) Sulawesi dalam agenda Catatan Akhir Tahun (CATAHU) Anti Korupsi dan Penegakan Hukum Tahun 2020, memaparkan data hasil pemantauan selama periode satu tahun.
Ketua Badan Pekerja ACC Sulawesi, Abdul Kadir Wakanubun menjelaskan, “Kebiasaan ACC setiap tahun, akan merilis catatan akhir tahun di Sulawesi selatan. Apa yang akan dipresentasikan hari ini, CATAHU 2020, memotret kinerja Kepolisian Polda dan Polres Sulsel dan Kejaksaan Negeri dan Tinggi Sulawesi Selatan,” jelasnya dalam pembukaan CATAHU 2020 via zoom, Senin (28/12/2020).
ACC Sulawesi mencatat adanya kinerja buruk dalam penegakan hukum tindak pidana korupsi yang ditangani oleh pihak Kejaksaan dan Kepolisian. Badan Pekerja ACC menunjukkan, Pelayanan terhadap keterbukaan informasi publik yang tidak transparan dan akuntabel, dalam penanganan tindak pidana korupsi sebagai catatan buruk kinerja Kejaksaan dan Kepolisian dalam kurun waktu 2019-2020.
Tidak hanya itu, ACC melaporkan, adanya jaksa nakal, tebang pilih kasus, dan mendiamkan kasus tertentu, turut terjadi dalam institusi penegakan hukum tersebut.
Angga Reksa, selaku Peneliti ACC Sulawesi menerangkan terjadi kesulitan untuk mengakses informasi pada kejaksaan tinggi. ,“Saat ini Kejaksaan Tinggi Sulawesi Selatan, telah menerapkan zona integritas. Namun, pada faktanya untuk mendapatkan informasi, ACC kesulitan. Setiap tahun, ACC selalu menyurat ke pihak terkait, tetapi tidak mendapatkan balasan,” terangnya.
Ia juga menyebutkan kasus Jen Tang yang telah ditetapkan sebagai daftar pencarian orang dalam kasus tindak pidana korupsi selama dua tahun, setelah ditangkap dan ditahan, justru mendapatkan SP3 (Pemberhentian Penyelidikan dan Penyidikan) dari Kejaksaan tanpa alasan hukum yang kuat.
ACC Sulawesi mencatat, modus pemberian SP3 kepada pelaku tindak pidana korupsi yaitu, diberikan secara diam-diam, saat perhatian publik teralihkan. Tak hanya itu, dalam pemberian SP3 juga ada dugaan telah terjadi praktik suap penegak hukum.
Begitu juga dengan berbagai alasan yang digunakan dalam pemberian SP3 yang tidak kuat secara hukum. Misalnya alasan pelaku telah mengembalikan kerugian negara, atau terganjal audit BPK/BPKP/Inspektorat. Hingga pemberian SP3 akibat pengaruh jabatan dan status politik.
Menurut Ali Asrawi Ramadan, salah satu Tim Peneliti ACC Sulawesi mengatakan, hal ini terjadi akibat Kajati Sulsel maupun Polda Sulsel, terkesan membiarkan Kejari dan Polres leluasa dalam menerbitkan SP3 tanpa disertai alasan yang patut dipertanggungjawabkan secara hukum.
“Dengan adanya penelitian tadi, maka dapat dikatakan proses penegakan hukum tidak tansparan. Lemahnya pemantauan Kejati dan Polda, mengakibatkan leluasanya pemberian SP3 oleh Kejari dan Polres,” katanya.
ACC Sulawesi mencatat, di Kepolisian, terdapat lima kali pemberian SP3 dalam satu tahun. Yakni ;1. Dugaan korupsi pengadaan kandang ayam Palopo (Polda Sulsel); 2. Dugaan korupsi dana PAUD Kab. Bone (Polda Sulsel); 3. Pengadaan buku Kurikulum 2013 (K-13) Dinas Pendidikan, Luwu Utara (Polres Luwu Utara); 4. Dugaan Korupsi Anggaran Dana Desa (ADD) Desa Mattiro Bone, Pangkep (Polres Pangkep); 5. Dugaan tindak pidana korupsi Dinas Lingkungan Hidup (DLHK) Kabupaten Bone (Polres Bone).
Perkara TIPIKOR Tahun 2020
Dalam pemaparan CATAHU 2020 ini, total 104 kasus yang telah ditangani di Sulawesi Selatan dalam priode waktu satu tahun. Lebih spesifik terdapat 51 kasus yang ditangani oleh Kepolisan dan 53 kasus oleh Kejaksaan. Untuk perkara Tindak Pidana Korupsi (TIPIKOR) yang sampai pada meja hijau hanya sebanyak 80 perkara dengan 81 terdakwa dengan putusan yang variatif.
Putusan tersebut mencakup putusan dengan Hukuman tertinggi sebanyak 6 tahun penjara dan denda 500 juta dan putusan terendah 1 tahun penjara serta denda 50 juta dan 5 putusan yang menyatakan bebas.
Untuk Perkara Korupsi selama 2 tahun di PN TIPIKOR Makassar terjadi penurunan dari tahun 2019-2020 jumlahnya 120 perkara menjadi 80 perkara dengan kerugian keuangan negara kurang lebih Rp. 95,12 M 2019 menjadi Rp. 59,17 M 2020.
Selain itu, aktor pelaku tindak pidana korupsi pada tahun 2020 menempatkan Pegawai Negeri Sipil sebagai aktor tertinggi dengan jumlah 38 orang. Aktor selanjutnya adalah swasta 16 orang, 12 Kepala Desa, 9 Perangkat Desa, 3 Honorer/Kontrak, 2 Prusda/BUMD, dan 1 Pengurus Koperasi.
Korupsi infrastruktur menjadi lahan subur tindak pidana korupsi. Ditemukan sebanyak 25 kasus korupsi di sektor infrastruktur, dilanjutkan sebanyak 17 kasus penyelewengan Dana Desa, 10 kasus di sektor Pendidikan, 9 Pemberdayaan Masyarakat, 7 Pelayanan Publik, 5 Kesehatan, 2 Pengadaan Barang dan Jasa, 2 BUMD, dan 1 Pilkada.
