Sidang Lanjutan Petani Soppeng Hadirkan Saksi Dari Terdakwa

Soppeng, Cakrawalaide.com – Tiga petani Soppeng yang dikriminalisasi akibat menebang kayu di kebunnya sendiri menjalani sidang lanjutan dengan agenda mendengar keterangan saksi dari terdakwa. Saksi tersebut terdiri dari saksi fakta dan saksi ahli. Sidang tersebut berlangsung di Pengadilan Negeri Watansoppeng. Selasa 17/11/2020.
Perlu diketahui ketiga petani Soppeng tersebut yaitu Natu, Armadi, dan Sabang. Mereka merupakan Petani Tradisional yang dianggap melakukan penebangan pohon tanpa izin serta pembalakan liar secara terorganisir di dakwa dengan pasal 12 (b) jo. Pasal 82 ayat 1 Undang-Undang nomor 18 tahun 2013 tentang Pencegahan dan Pemberantasan Perusakan Hutan (P3H).
Namun, menurut Ahmad Sofian selaku saksi ahli yang dihadirakan penasihat umum menuturkan bahwa ketiga petani tersebut tidak melakukan kegiatan yang terorganisir untuk merusak hutan sebagaimana yang didakwakan kepada mereka.
“Mereka melakukan penebangan kayu bukan untuk tujuan komersil. Bukan tujuan komersil bisa ditafsirkan bukan merupakan bagian dari sindikat yang terorganisasi,” tuturnya.
Pria yang berprofesi sebagai dosen Fakultas Hukum di Universitas Bina Nusantara (Binus University) ini juga mengungkapkan bahwa UU P3H ini dibuat untuk mengatasi secara masif kerusakan hutan serta memberantas pembalakan liar yang terorganisir, terstruktur dan sistematis bukan untuk masyarakat yang tinggal di sekitar atau di dalam kawasan hutan.
“UU P3H itu bukan digunakan untuk masyarakat sekitar hutan. jika polhut atau polisi membaca dan paham pasal 1 ayat 20, pasal 11 ayat 1,2 dan 3. Mereka pasti tau bahwa UU ini tidak bisa menjadikan tersangka masyarakat yang tinggal disekitar hutan. Cuman karena mereka tidak membaca itu. Mereka langsung lompat membaca tindak pidananya yah seperti inilah kejadiannya,” lanjutnya
Sementara itu, Andi Baso Petta Karaeng, Presiden Direktur dari Lembaga Hak Asasi dan Ekonomi Rakyat Indonesia (L-HERINDO) dalam ruang sidang sebagai saksi fakta menjelaskan bahwa beliau pernah melakukan pertemuan dengan pemerintah pusat di Jakarta 2018 silam, dalam pembahasan Rencana Tata Ruang Wilayah (RTRW) Sulawesi Selatan, Watansoppeng.
Dalam pembahasan RTRW tersebut telah disebutkan bahwa dalam kawasan hutan, suatu perkampungan dan telah ada bangunan yang memiliki peran sosial diatasnya harus dikeluarkan dan tidak masuk kawasan hutan.
“Perkampungan serta Bangun sosial harus dikeluarkan dari kawasan hutan seperti jalan, jembatan, dan sekolah,” jelas pria yang biasa di sapa Puang Baso.
Ia juga mengatakan selama ini pemerintah daerah tidak pernah memberi kejelasan soal status daerah di kampung Ale’ Sewo.
“Selama ini kami tidak pernah diberi kejelasan soal status kawasan hutan di kampung ini, mereka hanya memberitahu tentang kawasan. Tidak jelas apakah hutan konservasi, hutan lindung atau hutan produksi,” ujar pria kelahiran Bone itu.
Selain itu, pria yang akrab disapa Puang Baso ini juga memaparkan bahwa tidak semua daerah Kampung Ale’ Sewo yang berada dibawah bukit itu masuk sebagai daerah kawasan yang dimana pihak kehutanan mengklaim daerah tersebut merupakan hutan lindung.
“Hutan lindung di Soppeng itu seluas 45.000 hektar. Itu ada di neneconang – laposo. Sementara jarak antara kampung Ale’ Sewo ke neneconang – laposo ada sekitar 10 km,” ungkapnya.
Puang Baso juga menegaskan bahwa Ambo Natu merupakan petani turun-temurun yang sudah lama tinggal di daerah kawasan tersebut.
“Pak Natu itu sudah lama tinggal disini. Ia merupakan petani turun-temurun. Buktinya itukan tanamannya yang dia nikmati itu. Tanaman itu bukan satu tahun, sudah puluhan tahun itu. Seperti jati, kelapa dan sukun. Pokoknya banyak tanamannya didalam.” tutupnya.
