Terkait KS di Lutim, Kuasa Hukum Anggap Polres dan P2TP2A Tak Berperspektif Korban

Makassar, Cakrawalaide.com – Setelah liputan mendalam mengenai kasus Kekerasan Seksual (KS) terhadap anak di Luwu Timur Sulawesi Selatan, menjadi sorotan publik yang terbit pada 06 Oktober 2021. Pihak korban beberapa kali didatangi oleh pihak Polres Luwu Timur dan P2TP2A Luwu Timur. Kedatangan pihak tersebut dilakukan tanpa ada penyampaian sebelumnya kepada ibu korban atau koordinasi dengan pihak kuasa hukum.
Senin (12/10/21), tim kuasa hukum korban Koalisi Bantuan Hukum Advokasi Kekerasan Seksual terhadap anak menggelar konferensi pers sebagai bentuk pernyataan sikap merespon sejumlah perkembangan kasus Kekerasan Seksual terhadap anak di Luwu Timur.
Haedir selaku Direktur LBH Makassar, menganggap tindakan tersebut justru menunjukkan bahwa Polres Luwu Timur dan P2TP2A Luwu Timur tidak mempunyai perspektif perlindungan kepada korban dalam menangani kasus Kekerasan Seksual terhadap anak. Seharusnya, mereka memahami bahwa kedatangannya beserta publikasi dan peliputan oleh media telah menyalahi prinsip serta aturan perlindungan khusus terhadap anak yang berhadapan dengan hukum yakni hak atas kerahasiaan identitas.
“Tindakan tersebut menunjukkan kembali bahwasanya, Polres Luwu Timur dan P2TP2A Luwu Timur, tidak memiliki perspektif perlindungan terhadap korban dalam menangani kasus anak”, tuturnya.
Kemudian, Haedir juga membantah mengenai pernyataan P2TP2A Luwu Timur disejumlah media, yang dimana mengatakan bahwa interaksi antara para anak selaku korban dan terlapor pada saat dipertemukan dalam keadaan baik dan harmonis. Kesimpulan pada hal tersebut dianggap berbahaya dan dapat menyesatkan publik.
“Pendapat keliru petugas P2TP2A Luwu Timur ini juga menunjukkan lemahnya kapasitas petugas sehingga asesmen tersebut harus dikoreksi,” ungkapnya.
Ia menjelaskan bahwa keterangan para anak korban dalam dua dokumen tersebut justru diabaikan oleh penyidik Polres Luwu Timur dan proses selanjutnya resmi dihentikan pada 19 Desember 2019.
Tidak hanya itu, menurut psikolog Makassar yang memeriksa para anak setelah kasus ini dihentikan, tidak ditunjukkannya trauma oleh anak bukan berarti kekerasan seksual terhadap anak tidak terjadi.
Terlebih pada kasus kekerasan seksual yang dilakukan orang terdekat korban, yang umumnya tidak melakukan perbuatannya dengan cara-cara kekerasan, melainkan bujuk rayu, tipu muslihat, atau manipulasi.
Dalam dokumen hasil pemeriksaan terhadap korban, justru terdapat keterangan bahwa telah mendapatkan kekerasan seksual yang dialami. Sama halnya dalam Visum et Psychiatricum (VeP) terhadap para korban, masing-masing menceritakan peristiwa kekerasan seksual yang dilakukan oleh terlapor.
Diakhir konferensi pers yang berlangsung kurang lebih 1 jam, Haedir berharap proses pidana ini diambil alih oleh Mabes Polri. “Kami meminta proses pidana kasus ini diambil alih oleh Mabes Polri atau setidaknya oleh Polda Sulawesi Selatan dengan supervisi Mabes Polri untuk memastikan tidak ada lagi kesalahan prosedur dalam prosesnya,” harapnya.
Hal tersebut berdasarkan ketentuan Perkapolri No. 6 tahun 2019 Tentang Penyidikan Tindak Pidana. Mabes Polri dapat menindaklanjuti perkara melalui Gelar Perkara Khusus. Dalam Pasal 33 ayat (1) Perkap ini disebutkan Gelar Perkara Khusus dilakukan dalam rangka merespon pengaduan dari pihak yang berperkara dan/ penasehat hukumnya atau menindaklanjuti perkara yang menjadi perhatian masyarakat.
Selanjutnya menurut Penjelasan Pasal 1 angka 24 Perkapolri Nomor 6 tahun 2019 Tentang Penyidikan Tindak Pidana“Gelar Perkara adalah kegiatan penyampaian penjelasan tentang proses penyelidikan dan penyidikan oleh Penyidik kepada peserta gelar dan dilanjutkan diskusi kelompok untuk mendapatkan tanggapan/masukan/ koreksi guna menghasilkan rekomendasi untuk menentukan tindak lanjut proses penyelidikan dan penyidikan”.
