Cakrawalaide.com – Adanya Rancangan Undang-Undang (RUU) Omnibus Law tampaknya menjadi pemicu para kelas pekerja tidak bisa selow. Mereka yang terdiri dari buruh, terpelajar menengah ke atas, dan berbagai NGO begitu masif menghelat forum-forum diskusi ilmiah untuk membedahnya. Pamflet seruan aksi mogok nasional dengan tagar #GagalkanOmnibusLaw begitu ramai di timeline media sosial saya belakangan ini.

Bahkan sudah ada yang bergerak menyuarakan dengan lantang penolakan terhadap RUU Cipta Kerja di parlemen jalanan. Misalnya saja serikat buruh di kawasan industri Tangerang dan Banten, berbagai aliansi mahasiswa, aliansi pers, akademisi, organisasi masyarakat sipil, hingga partai oposisi.

Produk hukum yang diwaspadai ini diinisiasi oleh pemerintah. Dalam isinya memang menuai pro-kontra. Golongan pendukung dan yang menolak saling bertarung di berbagai media pemberitaan, baik lokal maupun nasional. Dalil-dalil berbasis empiris bersaing dengan dalih pembenaran, propaganda di medsos kian ramai berusaha memenangkan atensi masyarakat.

Namun, apasih sebenarnya yang membuat kelas pekerja tergerak? Yah, karena mereka akan merasakan dampak kerugiannya secara langsung, sedangkan yang diuntungkan hanyalah korporasi, politisi, dan birokrasi.

Apa Itu Omnibus Law?

Mula-mula kita pahami dulu apa sebenarnya Omnibus Law. Kata “Omnibus” berasal dari bahasa latin yang artinya “untuk semua” atau “menyeluruh”, sedangkan “Law” adalah hukum. Jadi bila digandengkan berarti suatu produk hukum yang sifatnya menyeluruh atau memiliki keterkaitan dengan berbagai objek.

Jika nantinya disahkan, Omnibus Law akan jadi satu-satunya acuan hukum, menggantikan atau mengalahkan undang-undang yang sudah ada sebelumnya. Itulah sebabnya Omnibus Law dapat juga dimaknai sebagai “Undang-Undang Sapu Jagat”.

Relevansi dan Kontroversi Omnibus Law Versi Jokowi

Metode Omnibus Law ini banyak digunakan di negara-negara yang menganut sistem Common Law, seperti AS, Kanada, Australia Irlandia, Turki, dan Selandia Baru. Omnibus Law memang miliki keunggulan : akan dengan cepat merapikan dan meringkas regulasi serta birokrasi yang dinilai kaku sehingga menghambat laju investasi.

Bagi pemerintah, konsep hukum ini sebagai jawaban dari tantangan era digital di depan mata. Hal ini disinggung oleh Jokowi saat pidato setelah pelantikannya sebagai Presiden 20 Oktober 2019 lalu. Alias menggelar karpet merah bagi investasi dan mengabaikan prinsip demokrasi. Menerebas prosedur dan ketentuan hukum yang berlaku di Indonesia.

Menurut Pakar Hukum Tata Negara dari UIN Syarif Hidayatullah Jakarta, Andi Syafrani, mengatakan bahwa sejumlah negara sudah mulai kapok menggunakan model Omnibus Law ini, lantaran dinilai tak demokratis.

“Sebenarnya negara-negara yang pakai ini sudah mulai kapok menggunakan model omnibus. Karena kalau bahasa mereka kritikannya adalah, ini prosesnya sangat jauh dari proses deliberative democracy (demokrasi yang melalui diskursus),” ujar Andi sebagaimana dikutip dari kompas.com.

Bila kita menyelisik sejarah, Indonesia adalah negara bekas jajahan Belanda. Nah, Belanda merupakan penganut sistem Civil Law. Berarti Indonesia juga condong menganut sistem hukum tersebut. Bukan Common Law.

Sumber keresahan akan keberadaan Omnibus Law ini, ialah menyangkut proses penyusunan yang tanpa melibatkan representatif dari kelas pekerja, cenderung manipulatif dan terkesan buru-buru. Hanya melibatkan kalangan tertentu. Padahal hakikat perundang-undangan bukan melulu apa yang diinginkan oleh legislatif, tetapi apa yang diinginkan oleh publik [Baca : UU No.12/2011 tentang Pembentukan Peraturan Perundang-undangan Pasal 10].

Problem utama yang menjadi perdebatan dalam Omnibus Law, lebih spesifik RUU Cipta Kerja adalah pada substansi dari pasal-pasal yang direvisi.

Beberapa undang-undang yang bakal di-sapu jagat-kan, yakni menyangkut ketenagakerjaan dan perizinan usaha yang dimasukkan ke RUU Cipta Kerja, terkait perpajakan ditautkan ke RUU Perpajakan, regulasi mengenai usaha kecil menengah menjadi RUU UMKM, serta peraturan mengenai perpindahan dan pengembangan ibu kota baru melalui RUU Ibu Kota.

Metode Omnibus pada praktinya dipakai untuk merampingkan undang-undang jadi beberapa kluster yang miliki kemiripan (Di Kanada dan AS). Namun, pada RUU Cipta Kerja malah menggabungkan 11 kluster sekaligus, padahal ada karakteristik dan paradigma hukum berbeda-beda. Selain itu, banyak regulasi mengenai ketenagakerjaan yang direvisi. Kelas pekerja meyakini hal ini akan sangat merugikan.

Dengan dalih produktivitas, RUU Cipta Kerja memangkas hari libur dalam sepekan. Dari 5 hari kerja, diubah menjadi 6 hari, serta menambah jam lembur. Demi efisiensi biaya produksi, maka diterapkanlah sistem upah per jam, membuat pekerja hanya dilihat sebagai mesin produksi. Upah Minimum Kota/Kabupaten (UMK) dihapus, disamaratakan dengan Upah Minimum Provinsi (UMP). Hak-hak buruh perempuan tercerabut, misalnya cuti haid, hamil, dan melahirkan. Kesemuanya itu dihapuskan, maka tidak ada kewajiban perusahaan untuk membayar pekerja saat berhalangan hadir. Bahkan buruh yang sedang hamil pun akan tetap (dipaksa) bekerja, jika tidak mereka terancam PHK. Begitulah nasib para buruh pabrik es krim Aice saat ini. Sungguh ironis.

Status pekerja juga semakin tidak menemui kejelasan (menggantung) dengan dihapuskannya kewajiban aturan untuk mengangkat pekerja tetap, serta perluasan pekerjaan konsep outsourcing (kerja kontrak). RUU Cipta Kerja ini benar-benar hanya didasari pada asumsi dari pihak pengusaha atau pemodal semata.

Berkaitan dengan lingkungan, RUU Cipta Kerja banyak memangkas perizinan yang diperlukan untuk menjaga kelestarian lingkungan dan melindungi ruang hidup dari aktivitas usaha (pertambangan) berlangsung. Area operasi usaha serta masa berlaku izin usaha (IUP, HGU, HTI, HPH) juga diperluas dan diperpanjang. Kerusakan lingkungan akan sangat dimungkinkan, mengingat pemanasan global menempatkan Indonesia sebagai salah satu negara yang memiliki alam yang rawan terhadap bencana karena berlokasi di cincin api.

Selain itu, peran pemerintah daerah dan partisipasi masyarakat dalam mengawasi jalannya sebuah kegiatan usaha tertepikan. Semua peraturan dan perizinan tersentralisasi ke pemerintah pusat, di mana kebijakan semacam ini rawan tidak tepat sasaran, karena setiap daerah memiliki kultur dan karakteristik yang berbeda.

Kita bisa belajar dari nasib warga Banyuwangi, Desa Sumberagung, warga Kec. Pesanggrahan yang rusak ruang hidupnya akibat aktivitas pertambangan emas di Gunung Tumpang Pitu dan Salakan oleh PT.BSI serta PT.DSI, sementara Gubernur Jatim, Khofifah, tidak mengambil sikap dan keputusan tegas untuk mencabut Izin Usaha Pertambangan (IUP) sesuai tuntutan warga yang sudah melakukan aksi kayuh sepeda dan mogok makan di depan kantornya selama kurang lebih 7 hari, menanti untuk ditemui. Apa lagi jika nantinya sentralisasi kekuasaan pusat itu terjadi?

Alasan pemerintah bersikeras dengan Omnibus Law juga berdasar asumsi yang diglorifikasi bahwa investor malas berinvestasi di Indonesia karena perizinan dan tingkat produktivitas yang rendah. Menurutnya, jika Omnibus Law tidak dilakukan, maka negara ini akan jatuh pada krisis ekonomi lagi.

Namun argumen ketakutan yang berusaha ditularkan oleh pemerintah tentang rendahnya produktivitas, pertumbuhan ekonomi yang lambat, dan tingkat kompetitif Indonesia yang buruk dengan sendirinya akan terbantahkan oleh data yang disajikan laporan World Economic Forum (WEF) 2017.

Dalam laporan itu ditemukan bahwa sebab investor menjauhi Indonesia bukanlah karena tingkat produktivitas pekerja ataupun regulasi mengenai lingkungan, melainkan ada 16 faktor yang menjadi penghalang investasi di Indonesia. Dari 16 faktor tersebut, tingkat korupsi parah menempati posisi pertama, disusul inefisiensi birokrasi, dan ketidak stabilan pemerintah.

Dari data tersebut, peraturan terkait ketenagakerjaan hanya berada di posisi ke-13. Maka patut kita mencurigai jika memang penyebab investor kabur adalah korupsi dan birokrasi, lantas mengapa regulasi tentang ketenagakerjaan, serta regulasi lingkungan hidup bakal dihapuskan. Bahkan regulasi tentang korupsi (UU KPK) malah direvisi, yang justru melemahkan lembaga anti rasuah tersebut (KPK).

Sebagai pengingat, regulasi yang dimuat dalam RUU Cipta Kerja memang bertujuan untuk menciptakan Labour Market Flexibility (LMF) atau Pasar Tenaga Kerja Fleksibel, dimana ada asumsi bahwa akan ada masa bonus demografi. Besarnya penduduk usia produktif (15 hingga 64 tahun) dalam suatu negara, dengan begitu perusahaan akan memiliki stok pekerja yang tidak terbatas serta pekerja bebas memilih pekerjaan yang disukainya. Hal tersebut mendasari bahwa pekerja tetap tak lagi diperlukan, tetapi cukup pekerja kontrak tanpa adanya jaminan sosial dan pesangon membebani pengusaha.

Namun RUU Cipta Kerja melupakan syarat penting dalam LMF, yakni skill dan pendidikan. Bonus demografi pun ibarat pisau bermata dua. Tanpa adanya kemampuan, maka hanya akan menghasilkan apa yang disebut Guy Standing sebagai kelas prekariat (kelas terdidik yang tidak memiliki pekerjaan dan penghasilan yang jelas). Kelas ini lah yang diramalkan oleh Guy Standing sebagai biang dari kriminalitas dan rasisme di era ini.

Ada baiknya pemerintah mempertimbangkan untuk tidak melanjutkan proses legislasi tersebut. Perlu kiranya kita mentadaburi bersama makna Al-Quran surat Al-A’raf ayat 56, sebelum mengesahkan Omnibus Law, dan sebelum kehancuran itu datang lebih cepat. Perlu diingat bahwa tingkat perekonomian tinggi di suatu wilayah, tidak melulu selaras dengan tingkat kebahagian dan kesejahteraan rakyatnya. Kedaulatan ada di tangan rakyat, bukan di tangan pasar/investor, Pak Jokowi Dodo!
