Pengadilan Negeri (PN) Makassar Gelar Sidang Pemeriksaan Saksi Paniai Berdarah

Makassar, CakrawalaIde.com – Pengadilan Negeri (PN) Makassar kembali menggelar sidang lanjutan dari sidang perdana yang sebelumnya digelar pada Rabu, 21 September 2022 terkait kasus Paniai Berdarah. Sidang yang digelar hari ini, dimulai pada pukul 11.00-18.22 WITA. Rabu (28/09/2022).
Peristiwa Paniai Berdarah pada tanggal 08 Desember 2014 lalu yang mengakibatkan jatuhnya 5 korban jiwa bertempat di Lapangan Karel Gobay dan Kantor Komando Rayon Militer (Koramil), Enarotali di Jalan Karel Gobay Kampung Enarotali, Distrik Paniai Kabupaten Paniai, Provinsi Papua (dahulu Provinsi Irian Jaya).
Sidang yang digelar dengan status perkara Pemeriksaan Saksi dengan menghadirkan 4 saksi yaitu Andi Ricko Amir (TNI), Abner Windesi (Polri), Ridho Bakaraya (Polri), dan Alle Womra (Polri). Sidang hari ini juga menghadirkan terdakwa Mayor Inf. (Purn.) Isak Sattu selaku Perwira Penghubung (PABUNG) pada saat kejadian.
Andi Ricko Amir selaku ajudan 1 TNI yang bertugas saat itu, mengatakan bahwa pada saat kejadian, saksi sedang memanaskan mobil dan anggota lainnya sedang mempersiapkan untuk melakukan apel pagi di Koramil Enarotali Paniai.
“Pada saat memanaskan mobil sudah ada warga yang mengelilingi Koramil, saat itu dan warga mulai melempar batu dan panah ke arah Koramil,” ungkapnya.
Saat itu warga Paniai berkumpul melakukan unjuk rasa dengan mempersembahkan tarian adat Waiita di halaman Polres dan Koramil. Tarian tersebut sebagai bentuk pernyataan sikap atas tindakan represif para aparat kepada warga dan meminta aparat melakukan pertanggung jawaban terhadap remaja yang dipukul.
Massa kemudian datang dengan meneriakkan, “Tanggung jawab atas kejadian semalam!.” Teriak massa secara serentak menuju Koramil dan Polres.
Salah seorang massa memanjat pagar dan mulai dilayangkan tembakan peringatan ke udara sebelum ditembakkan ke arah korban, saksi mengidentifikasi pelaku penembakan atas nama Gatot yang merupakan anggota TNI dengan jarak 2 meter. Setelah penembakan massa berlarian mundur dan salah seorang anggota TNI mengejar massa hingga ke lapangan dan menikam korban.
“Saat massa mundur saya berada di belakang Jusman sampai di lapangan, Jusman menikam warga di bagian depan dan menikam korban dari samping. Setelah itu saya lari ke arah Polres untuk menyelamatkan diri,” lanjut Andi Ricko Amir.
Tetapi, Ridho Bakaraya selaku anggota Polri memberikan kesaksiannya yang juga menyaksikan penikaman yang dilakukan oleh Jusman pada saat kejadian pelaku hanya sendiri di lokasi dan menikam korban tanpa adanya orang lain, jarak antara saksi 3 sekitar 10 meter dari kejadian.
“Pada saat itu saya bersembunyi di balik tong sampah untuk mengamankan diri dan melihat adanya penikaman oleh anggota TNI ke warga, saat itu pelaku hanya sendiri dan tidak ada orang lain di sekitarnya,” ungkapnya.
Abner Windesi dan Ridho Bakaraya yang merupakan anggota Polri juga memberikan saksi bahwa mereka saat itu bersama Kapolres menuju Polres yang di perintahkan oleh Wakapolres dan pada saat kejadian Kapolres berada di dalam Polres. Di lokasi kejadian tidak hanya Koramil saja tetapi ada 3 instansi lain yaitu Polres, KOPASSUS dan Koramil.
Alle Womra selaku anggota Polri pada saat masssa melakukan pelemparan, anggota Polres melakukan tembakan peringatan dan tidak ada perintah. Sekitar 20 lebih anggota Polsek di dalam Polres dan tidak semua memiliki senjata hanya kurang lebih 5 orang yang memiliki senjata api. Alle Womra melakukan penembakan peringatan sebanyak 3 kali ke arah atas.
Peristiwa Paniai ini merupakan pelanggaran Hak Asasi Manusia (HAM) yang dilakukan oleh para aparat terhadap warga Paniai dan Peristiwa Paniai ini tergolong ‘Kejahatan Terhadap Kemanusiaan’ yang merupakan Pelanggaran HAM Berat tertera dalam UU Pengadilan HAM pasal 9 UU No 26 Tahun 2000 : Kejahatan terhadap kemanusiaan sebagaimana dimaksud dalam Pasal 7 huruf b adalah salah satu perbuatan yang dilakukan sebagai bagian dari serangan yang meluas atau sistematik yang diketahuinya bahwa serangan tersebut ditujukan secara langsung terhadap penduduk sipil. Sidang akan dilanjutkan pada hari Senin dan Kamis mendatang.
