Kawal Kasasi, Aliansi Bara-Baraya Kembali Turun ke Jalan

Makassar, Cakrawalaide.com – Aliansi Bara-Baraya kembali berdemonstrasi di depan Pengadilan Tinggi Kota Makassar menuntut usut dan periksa majelis hakim yang akan memutus perkara Bara-Baraya serta mereka dengan tegas berkomitmen mengawal kasasi Bara-Baraya. Selasa (07/09/2021).
Tiga perwakilan warga Bara-Baraya bersama kuasa hukum warga dari LBH Makassar mendatangi Pengadilan Tinggi Makassar untuk menghadap ke tim pemeriksa. Hal ini merupakan tindak lanjut atas pengaduan warga dan permohonan pengawasan ketat atas perkara sengketa tanah yang terjadi di Bara-Baraya kepada Mahkamah Agung (MA) pada April lalu.
Warga Bara-Baraya melampirkan bukti-bukti atas dugaan pelanggaran teknis yudisial dan hukum acara oleh majelis hakim pada Pengadilan Negeri Makassar dan majelis hakim maupun pada Pengadilan Tinggi Makassar yang mengeluarkan putusan sengketa yang dimaksud.
Berdasarkan keterangan tersebut, perwakilan warga menyampaikan pihak-pihak terlapor diduga telah melanggar prinsip-prinsip transparansi dan non diskriminasi dalam sistem peradilan bersih.
Andarias selaku perwakilan warga Bara-Baraya yang masuk menemui tim pemeriksa Pengadilan Tinggi Makassar mengungkap masih ada permainan perkara ini sehingga akan terus mengawalnya serta berharap para hakim agung agar dapat mengambil keputusan tanpa adanya intervensi dari luar.
“Harapan kami agar hakim agung bisa mengambil keputusan yang adil, benar, dan bijak sehingga apa yang jadi putusan di Pengadilan Tinggi dianulir dan betul-betul mereka menganggap itu keputusan yang keliru,” ungkapnya.
Heri yang juga merupakan warga Bara-Baraya menyatakan bahwa hasil pertemuan tadi, para tim pemeriksa telah menampung dan menerima aduan-aduan warga terkait mal administrasi dan pelayanan publik
“Tim pemeriksa akan segera menindaklanjuti permohonan kami dan semua aduan warga mereka telah tampung serta akan memeriksa pihak-pihak terlapor,” tuturnya.
Ia menambahkan bahwa warga Bara-Baraya akan tetap bersolidaritas untuk melakukan pengawasan pada perkara ini.
“Itu adalah tujuan awal kami yakni terus melakukan pengawasan pada perkara ini,” tambahnya.
Ia juga berharap agar kasasi ini dilakukan dengan proses mekanisme peradilan yang bersih.
“Kalau harapan kami, ya paling tidak untuk diproses kasasi ini semoga betul-betul berlangsung sesuai dengan mekanisme peradilan yang bersih agar hakim dalam memutuskan secara independen sehingga warga betul-betul memperoleh keadilan dalam perkara ini sesuai dengan fakta yang ada,” tutupnya.
